Garrison man sentenced
A Garrison man has been sentenced to serve six years and six months in federal prison for his part in a voluntary manslaughter case that took place in White Shield Dec. 10, 2008.
Jesse McKenna, 22, was sentenced Monday in U. S. District Court in Bismarck by Judge Daniel L. Hoveland.
The six-year-six-month sentence will be followed by three years of supervised release. McKenna was ordered to pay restitution of $5,534.21 and to pay a $100 special assessment to the Crime Victim’s Fund.
Co-defendant Duane Bear received the same sentence Jan. 25. McKenna pleaded guilty to the charge Nov. 4, 2009.
According to court documents, McKenna, co-defendant Bear, the victim, a 16-year-old male juvenile who was identified in court documents only as “L.M.”, and another individual, were at Bear’s residence. The group was consuming alcohol when the victim and Bear began to argue. The victim allegedly pulled out a small switchblade knife while Bear grabbed a scissors. McKenna hit the victim in the head with a fist, knocking him to the ground, causing the knife to fall out of his hand. The victim was then kicked in the head, face, and body.
