Commission nixes permit for Kings

In a three-to-two vote, Washburn’s Planning and Zoning Commission recommended not approving a conditional use permit for a business being run in a residential area.
Over 20 attendees crowded into Washburn City Hall Monday night to discuss a conditional use permit filed by Lawrence and Jessica King, who operate A&C Land Development.
A complaint was brought to the zoning commission in June by neighbors of the Kings who argued that storing equipment at the residential lot on Fifth Avenue did not comply with city zoning ordinances.
The Kings’ lot is currently zoned residential, which allows for a home occupation, though the commission was unsure if the excavating business qualified.
Liz Patterson said the zoning ordinance is specific on noise limitations and other restrictions in order to qualify as a home occupation and that she didn’t think it fit this situation.
Jessica King addressed the commission first during the meeting to address concerns that had been listed at a previous zoning meeting and June and a later city commission meeting.
