Northwest Landowners Association wins legal battle over pore space rights
Northwest Landowners Association (NWLA) has opposed Senate Bill 2344 since it was introduced during the 2019 Legislative Session. The goal of the organization’s lobbying to prevent the bill from passing is to “protect the property rights of private landowners and protect the rights of North Dakota’s citizens to their pore space,” according to a news release. Northwest Landowners Association filed a complaint in State District Court asking to declare Senate Bill 2344 unconstitutional, based on eminent domain, or taking of private property. North Dakota historically has one of the toughest eminent domain laws in the country, meaning the government needs to
make a very strong case to procure private property.
